Powerhouse Cheer Academy Sports Waiver and Release of Liability
1. Acknowledgment of Risk
I, the undersigned, fully understand that participation in cheerleading activities, including but not limited to stunting, tumbling, jumps, and conditioning exercises, involves inherent risks. These risks may include but are not limited to physical injury, such as muscle strains, fractures, sprains, head injuries, paralysis, or death. I understand that cheerleading requires physical exertion and contact, which may result in unexpected harm or injury.
2. Assumption of Risk
I hereby voluntarily and expressly assume all risk of injury, death, or property damage while participating in any activities at Powerhouse Cheer Academy. I acknowledge that I am voluntarily participating in these activities and that I am aware of the potential dangers involved.
3. Release of Liability
I, on behalf of myself and my heirs, assigns, and personal representatives, hereby release, waive, and discharge Powerhouse Cheer Academy, its coaches, directors, employees, volunteers, and any other associated parties, from any and all claims, liabilities, damages, or injuries, whether caused by negligence or otherwise, that may arise out of participation in cheerleading activities. I agree not to hold Powerhouse Cheer Academy responsible for any pre-existing conditions or injuries that may worsen as a result of participation.
4. Indemnification Clause
I agree to indemnify and hold harmless Powerhouse Cheer Academy, its directors, coaches, employees, and affiliates from any claims, damages, or expenses, including legal fees, resulting from my or my child’s participation in the program or from any third-party claims arising out of our involvement with Powerhouse Cheer Academy.
5. Medical Treatment Authorization and Responsibility
In the event of an injury or medical emergency, I authorize Powerhouse Cheer Academy staff to seek appropriate medical treatment for the participant. I understand that I am responsible for all medical costs associated with any injuries sustained during participation in activities, regardless of any insurance coverage that may be in effect. I acknowledge that Powerhouse Cheer Academy does not provide medical insurance for participants.
6. Fitness to Participate
I confirm that the participant is in good physical condition, has no known medical conditions, injuries, or illnesses that would prevent safe participation in cheerleading, and has been cleared by a physician for such activities if necessary. I understand it is my responsibility to ensure the participant is medically fit for all activities, and I will inform Powerhouse Cheer Academy of any changes in health or fitness status.
7. Consent for Media Release
I give permission for Powerhouse Cheer Academy to photograph, videotape, or otherwise record my/my child’s participation for promotional purposes, including but not limited to social media, websites, and marketing materials. I understand that no compensation will be provided for such use. I agree that all media captured remains the property of Powerhouse Cheer Academy and waive any rights to inspect or approve the use of such media.
8. Payment and Fee Agreement
Tuition and Fees: I agree to pay all required monthly fees for participation in the Powerhouse Cheer Academy program. These fees are due on the 1st of each month, and continued participation is contingent on maintaining an up-to-date payment status.
Payment Method: I authorize Powerhouse Cheer Academy to initiate electronic debit entries from the account I provide. In cases of failed payments, a $25 fee will be charged for each occurrence, and Powerhouse Cheer Academy reserves the right to suspend participation until all outstanding payments are made.
Refund Policy: I acknowledge that registration fees, competition fees, and previously paid tuition are non-refundable. In the event of withdrawal or dismissal from the program, no refunds will be issued for unused sessions or fees.
Missed Payments: I understand that if my account falls behind by more than 30 days, Powerhouse Cheer Academy reserves the right to remove the participant from the program until the account is brought up to date. Failure to make payments in a timely manner may lead to the termination of the participant’s place on the team.
9. Fraudulent Payment Claims and Chargebacks
I agree not to dispute valid transactions for program tuition and fees with my financial institution. In the event of a fraudulent claim or chargeback for valid payments made to Powerhouse Cheer Academy, I acknowledge that I am liable for all associated fees, costs, and any outstanding balances due.
10. Code of Conduct and Dismissal Policy
I acknowledge that Powerhouse Cheer Academy expects respectful behavior from all participants and parents. Any behavior deemed inappropriate, unsafe, or disruptive to the learning environment may result in suspension or permanent removal from the program without refund.
11. Agreement to Terms
By signing up and registering for our academy, you acknowledge that you have read and fully understand this waiver, release of liability, payment, and refund agreement. You voluntarily agree to all terms and conditions and confirm that no oral representations, statements, or inducements have been made to me in connection with this agreement. You also agree to receive calls, texts and emails from Powerhouse Cheer Academy.
